TERMS OF SERVICE

Effective: June 21, 2026

These Terms of Service ("Terms") are a binding agreement between you and Pine Tree Trail's Custom Creations LLC ("PTTCC LLC," "we," "us," or "our"), the operator of pinetreetrail.com (the "Site"). The Site offers specialty products and informational services. By accessing or using the Site, creating an account, or making a purchase, you agree to these Terms. If you do not agree, do not use the Site.

1. ELIGIBILITY

You may browse the public information on the Site regardless of age. To create an account, make a purchase, or submit user content (such as posts or comments), you must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal authority to enter into these Terms. By creating an account, making a purchase, or submitting user content, you represent that you meet these requirements and that your use is not prohibited under any law that applies to you.


2. WHAT THE SITE IS

The Site is an informational platform about the Pine Tree Trail and the places along it, and it also sells specialty products. It includes a business directory, an interactive map, a trip planner, a blog, an online store, and paid memberships. We compile information about roads, trails, businesses, landmarks, and other locations from public and third-party sources and present it for general informational purposes. We are a publisher of that information. We do not own, operate, control, inspect, maintain, or guarantee any of the roads, trails, businesses, landmarks, or other locations described on the Site, and we do not direct anyone into backcountry or off-route areas.


3. ASSUMPTION OF RISK AND PERSONAL SAFETY

Travel and outdoor recreation carry inherent risks. By using the Site and any information on it, you knowingly and voluntarily assume all risks associated with the activities and locations described, including but not limited to:

- Accessibility. An accessible parking area does not mean a trail, site, or route is safe or navigable for any particular person. You are responsible for assessing the actual trail or site and the abilities of yourself and anyone in your care, including individuals with mobility, sensory, or other needs.
- Safety equipment. You are responsible for using appropriate safety equipment for each activity, such as life jackets or personal flotation devices on the water, helmets while biking, and proper footwear, clothing, and water for hiking.
- Roads without shoulders. Many segments of the route have no shoulder. If you walk or bicycle the route, you may share the road with motor-vehicle traffic at speeds up to 55 miles per hour on highways such as U.S. Route 1 and U.S. Route 2. You are responsible for obeying all traffic laws and using your own judgment.
- Third-party and natural conditions. Roads, trails, water, weather, wildlife, terrain, and the condition and operation of third-party locations -- including club, business, and privately owned trails and properties -- are outside our control and may change without notice.
- All other risks inherent in outdoor recreation and travel.

You are solely responsible for your own safety and for the safety of anyone in your care. Before relying on any information on the Site, you must independently verify current conditions, hours, fees, access, and safety directly with the relevant business, landowner, club, or authority. We do not warrant that any location or route is safe, open, accessible, or in any particular condition.

For current laws, rules, road and travel conditions, boating and recreation regulations, and traveler safety, consult official sources directly, including the State of Maine (maine.gov), the Maine Department of Transportation, the Maine Department of Inland Fisheries and Wildlife, the Maine Bureau of Parks and Lands, and the specific business, landowner, club, municipality, or authority responsible for a location.


4. NO ENDORSEMENT; ACCURACY OF INFORMATION

Information on the Site is provided "as is" and is compiled from public and third-party sources. It may be inaccurate, incomplete, or out of date. We do not warrant its accuracy and do not endorse or guarantee any business, location, product, or service listed. Listing a place on the Site is not a representation that it is safe, open, or suitable for you. Listings, hours, fees, access, routes, and the availability and condition of stops, boat launches, businesses, and other locations are subject to change without notice.


5. ACCOUNTS

If you create an account, you agree to provide accurate information, keep your login credentials secure, and accept responsibility for all activity under your account. You must be 18 or older. We may suspend or terminate accounts that violate these Terms.


6. PURCHASES, PRICING, AND PAYMENTS

When you buy a product, membership, or business listing, you are responsible for reading the full listing or plan details before you commit, and you enter into a binding contract to purchase when you complete checkout. Prices for products and services are shown on the Site; we may change prices at any time and may correct pricing errors that occur. Applicable taxes and any transaction fees are charged to your payment method along with the price.

Payments are processed by Wix Payments. Paid memberships and business listings are billed in advance according to the plan you select and may renew automatically until cancelled. You may cancel at any time; cancellation stops future billing, and any automatically renewing membership or listing continues only through the end of the period for which you have already paid.


7. MEMBERSHIPS AND THE TRIP PLANNER

The Site includes a Trip Planner that lets members build a trip along the route by saving stops and writing trip notes. What you can do in the Trip Planner depends on your membership.

Free membership. A free membership lets you create up to two (2) trips in any 12-month period, with up to six (6) stops per trip and trip notes of up to 250 characters per trip. Each free trip remains available for seven (7) days after you begin adding stops to it; after that period the trip and its contents are removed.

Trail Cruiser membership. A paid Trail Cruiser membership lets you create up to ten (10) trips in any 30-day period, with up to fifty (50) stops per trip and trip notes of up to 2,500 characters per trip. Your trips remain available while your plan is active. Billing and automatic renewal are described in Section 6.

One active trip at a time. You may have one active trip at a time. To start a new trip, finish or delete your current one.

Deleting and restoring a trip. When you delete a trip, it is not erased right away. Your stops and notes are held for 30 days, and during that time you may restore that trip until you start a new one. After 30 days, a deleted trip and its contents are permanently removed. Restoring a trip counts as one of your trips, the same as creating a new one.

Trip allowances. Creating a trip and restoring a deleted trip each count toward your trip allowance for the applicable period -- two (2) trips in any 12-month period on a free membership, and ten (10) trips in any 30-day period on Trail Cruiser. Each trip you create or restore counts against that allowance until it ages out of the period. On a free membership, once your allowance is used, you must upgrade to Trail Cruiser to plan or restore additional trips.

If your paid plan ends. If your Trail Cruiser plan ends, your saved trips are held for 30 days after the plan ends so that you can renew and pick up where you left off. After 30 days, your saved trip data is permanently removed. Ending a paid plan returns you to free membership and does not reset your free trip allowance: trips you created or restored while on a paid plan continue to count toward your allowance until they age out of the applicable period.

Changes and fair use. These limits are part of the service and may change. We may also take reasonable measures to prevent abuse of the Trip Planner and to keep the Site available for everyone. We will reflect any material change to these limits here or in the relevant plan details.


8. RETURNS, REFUNDS, WARRANTY, AND PRODUCT SAFETY

Returns and refunds. If you are unsatisfied with a product, return it with its accessories and original packaging, along with the original receipt or gift receipt, within 14 days of the date you receive it, and we will exchange it or issue a refund to the original payment method. Products may be returned only in the country where they were purchased. Unboxed goods are not eligible for return, and all returns must include the original box, packing material, and receipt or packing slip. Except as stated here or required by law, membership and listing fees are non-refundable.

Product warranty. If we receive a valid warranty claim for a product purchased from us, we will repair the defect or replace the product. If we cannot repair or replace it within a reasonable time, you are entitled to a full refund upon return of the product. We pay for shipping of repaired or replaced products to you.

Product safety and use. You are responsible for using, installing, and displaying our products safely and for following any instructions provided. Our metal signs and similar items are decorative products. If you display a sign outdoors, secure it with hardware appropriate for the surface and conditions; do not leave a sign unsecured outdoors, as wind can dislodge it and cause it to become airborne and strike people or objects. You assume responsibility for the safe installation, placement, and use of any product you purchase, and PTTCC LLC is not responsible for injury or property damage resulting from improper installation, placement, or use.


9. USER CONTENT

The Site may let you submit content, such as blog posts, comments, and profile information ("User Content"). You retain ownership of your User Content, and you grant us a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute it in connection with operating and promoting the Site. You are responsible for your User Content and represent that you have the rights to submit it and that it does not violate any law or these Terms. You may not submit content that is illegal, infringing, defamatory, harassing, hateful, obscene, or that invades another person's privacy. Member posts may be subject to our review and approval before publication. We may remove, refuse, or edit User Content at our discretion, and we are not obligated to monitor it.


10. ACCEPTABLE USE

You agree not to use the Site to violate any law; infringe anyone's rights; harvest or scrape data; introduce malware; interfere with the Site's operation or security; impersonate others; or collect other users' information without consent.


11. INTELLECTUAL PROPERTY

Except where otherwise noted, and excluding stock photos and other third-party content, the Site and all materials on it -- including software, images, text, graphics, logos, trademarks, service marks, copyrights, photographs, audio, and video -- are the exclusive property of PTTCC LLC or its licensors and are protected by law. We grant you a limited, personal, non-commercial license to use the Site. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adapt, or create derivative works from the Site or its content without our permission, except for content you submit or content clearly made available for sharing.

"Pine Tree Trail" and the Pine Tree Trail sign image are marks associated with PTTCC LLC. If you are interested in selling products, wholesale or retail, that bear the "Pine Tree Trail" sign image, contact us at info@pinetreetrail.com for licensing.


12. THIRD-PARTY LINKS AND SERVICES

The Site links to and relies on third-party websites and services, including business websites, social media pages, and mapping services such as Mapbox. We do not control these third parties and are not responsible for their content, conduct, availability, or privacy practices. Your use of them is at your own risk and subject to their own terms.


13. DISCLAIMER OF WARRANTIES

Except for any express product warranty stated in these Terms, the Site and all content, information, and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.


14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, PTTCC LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages -- including loss of profits, goodwill, data, or other intangible losses -- or for (a) errors or inaccuracies in content; (b) any personal injury or property damage arising from your access to or use of the Site, its information, our products, or any location or activity described on the Site; or (c) any unauthorized access to or use of our servers or any information stored on them. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.


15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless PTTCC LLC and its members, officers, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your User Content, your violation of these Terms or any law, or your participation in any activity or visit to any location described on the Site.


16. PROMOTIONAL COMMUNICATIONS

From time to time we may send you promotional messages and materials by email or postal mail using the contact information you provide. You can opt out of promotional messages at any time by using the unsubscribe link in an email or by contacting us at info@pinetreetrail.com.


17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in a court of competent jurisdiction located in Bangor, Maine, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.


18. COPYRIGHT / DMCA

If you believe content on the Site infringes your copyright, contact us at info@pinetreetrail.com with a description of the work, the location of the material on the Site, your contact information, and a statement of your good-faith belief that the use is unauthorized. We will respond as required by the Digital Millennium Copyright Act.


19. TERMINATION

We may suspend or terminate your access to the Site at any time, with or without notice. Sections that by their nature should survive termination -- including those on User Content licenses, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution -- will survive.


20. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted means you accept the updated Terms. If we make material changes, we will note the update here.


21. MISCELLANEOUS

These Terms are the entire agreement between you and PTTCC LLC regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may.
